Welcome to Wakatoo! These Terms of Use and Sale (the « Terms ») govern the use of the Wakatoo mobile application and the wakatoo.com website. By creating an account or using the application, you accept them without reservation. If you do not agree with any of these terms, please do not use the service.
This is an English translation provided for convenience. In the event of any discrepancy between this translation and the French version (« Conditions Générales d’Utilisation et de Vente »), the French version shall prevail.

2. The Wakatoo service
Wakatoo is a didgeridoo learning application that offers:
- A learning path: progressive quests, breath cards to unlock, rhythm exercises, experience points (XP) and rewards;
- Creation tools: a sequencer to write and play your own rhythms, a practice mode with audio recording;
- A library: scores and rhythms ready to play;
- Courses: in-depth video courses, available for individual purchase;
- A community: public profile, followers and following, private messaging, sharing of rhythms and of your instrument collection, and discovery of members near you (« Around you », based on your profile city — can be turned off in the privacy settings).
Part of the service is free; some features require a subscription or a purchase (see Section 5).
Wakatoo is continuously improved: features may be added, modified or removed at any time, without prejudice to your current purchases.
3. User account
3.1 Registration
An account is created with an e-mail address and password, or through a Google, Apple or Facebook account. You agree to provide accurate information and to keep it up to date.
3.2 Minimum age
Wakatoo is reserved for people aged 15 or over. As the application includes community features (public profiles, messaging), minors under 15 are not allowed to create an account. If we discover that an account has been created by a person under 15, it will be deleted.
3.3 Security
You are responsible for keeping your credentials confidential and for any activity carried out from your account. In case of unauthorised use, notify us immediately at contact@wakatoo.com.
3.4 One account per person
The account is personal: it may not be transferred, lent or sold.
4. Licence to use the application
We grant you a personal, non-exclusive, non-transferable and revocable licence to use the application, for private and non-commercial use. It is forbidden to copy, modify, decompile, resell or commercially exploit the application or its content (sounds, cards, teaching method, scores, videos) without written authorisation.
5. Subscriptions and purchases
5.1 The plans
Wakatoo offers a full-access subscription, monthly or yearly, as well as courses available as a one-time purchase or by subscription. The price (including VAT) and the length of each offer are shown in the app and on the App Store or Google Play page before any purchase. The applicable price is the one displayed at the time of purchase.
The applicable prices are those displayed in the application at the time of purchase. They include all taxes (VAT) and may vary depending on your country. We may change our prices; a price change on a current subscription will be notified to you by Apple or Google in accordance with their rules, and you will be able to cancel before it takes effect.
5.2 Free trial period
When you create your account, you receive 7 days of free access to the features of the Library tier. This trial requires no payment method and does not automatically convert into a paid subscription: when it ends, your account simply returns to the free version.
5.3 Purchase and renewal
Subscriptions and purchases are made exclusively through the App Store (Apple) or Google Play (Google), which process the payment. We never have access to your banking details.
Subscriptions renew automatically: they are renewed at the end of each period (monthly or yearly) unless cancelled at least 24 hours before the renewal date.
5.4 Cancelling a subscription
You can cancel at any time directly in your Apple or Google account:
- iOS: Settings → your name → Subscriptions;
- Android: Google Play → Profile → Payments and subscriptions → Subscriptions.
Cancellation takes effect at the end of the current, already-paid period; it does not give rise to a pro-rata refund.
5.5 Individual courses
Courses purchased individually are permanently attached to your Wakatoo account, with no time limit, for as long as the service exists.
6. Right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to digital content supplied immediately after purchase, where you have expressly consented to its immediate performance and waived your right of withdrawal — which is the case for purchases in Wakatoo: access to the content is immediate.
Refund requests are governed by the policies of Apple (reportaproblem.apple.com) and Google (Google Play → order history), which process the payments. You can also write to us at contact@wakatoo.com: we will review your situation with goodwill.
7. Your content
7.1 What is yours stays yours
The content you create or publish in Wakatoo (rhythms, shared recordings, photos of your instruments, avatar, messages) remains your property.
7.2 Licence you grant us
To operate the service (displaying your profile to other members, delivering your shares, hosting your photos), you grant us a worldwide, free and non-exclusive licence to host, reproduce and display this content, limited to the operation of Wakatoo. This licence ends when you delete the content or your account, subject to shares already made with other members.
7.3 Your warranties
You warrant that you hold the rights to the content you publish and that it does not infringe the rights of third parties (copyright, image rights, privacy).
8. Community rules
Wakatoo is a supportive learning space. It is strictly forbidden to:
- publish unlawful, hateful, discriminatory, violent or pornographic content, or content infringing the rights of others;
- harass, threaten or impersonate another member;
- send unsolicited commercial messages (spam);
- collect data about other members;
- disrupt the operation of the service (intrusion attempts, circumvention of protections, use of bots).
Any content or behaviour in breach of these rules can be reported to contact@wakatoo.com. We may remove content, suspend or delete an account in case of breach, with or without prior notice depending on the severity.
9. Wakatoo’s intellectual property
The application, its name, logo, teaching method, breath cards, sounds, scores, videos, texts and graphic elements are protected by intellectual property law and remain the exclusive property of the publisher or its licensors. Any unauthorised reproduction or distribution is prohibited.
10. Personal data
The processing of your personal data is described in our Privacy Policy, which forms an integral part of these Terms.
11. Availability and liability
We do our best to provide a high-quality, accessible and secure service, but we cannot guarantee uninterrupted availability: maintenance, outages or force majeure events may occur.
Wakatoo is an educational tool: progress depends on your practice. We cannot be held liable for indirect damages related to the use of the service, nor for content published by members — which we moderate after the fact, upon report. Nothing in these Terms excludes liability that cannot legally be limited.
12. Deleting your account
You can delete your account at any time, directly in the application (Profile → Settings → Delete my account) or by writing to contact@wakatoo.com. Deletion results in the loss of your progress, your content and your current paid access (purchases made through Apple/Google remain subject to their refund rules).
13. Changes to these Terms
We may modify these Terms, in particular to reflect changes in the service or in regulations. In the event of a substantial change, you will be informed in the application or by e-mail at least 15 days before it takes effect. Continued use of the service constitutes acceptance of the new terms.
14. Consumer mediation and disputes
In case of a complaint, contact us first at contact@wakatoo.com: most difficulties are easily resolved at this stage.
In accordance with Articles L611-1 et seq. of the French Consumer Code, if no solution is found within two months, you may make free use of the consumer mediator to which we belong:

15. Governing law
These Terms are governed by French law. If you reside in another European Union country, you retain the benefit of the mandatory consumer protection provisions of your country of residence. Failing amicable resolution or mediation, the competent courts will be determined according to the applicable legal rules.
